Another Kenyan MP loses seat

Starehe MP Bishop Margaret Wanjiru has lost her parliamentary seat after the high court ruled that she was not validly elected during the 2007 elections.
Wanjiru who is also the housing assistant minister now becomes the seventh legislator to be sent home through an election petition.
Justice Kihara Kariuki ruled on Friday that the ODM MP was not validly elected in thepoll that was marred by violence and other election malpractices.
Former MP Maina Kamanda in his petition had asked the court to announce him the area MP if at all Wanjiru loses in the petition.
Justice Kariuki however declined to declare the former Sports Minister saying the 2007 poll was marred by many irregularities and that only a by-election would be sufficient to determine the winner.
According to a vote recount conducted in April this year, Bishop Wanjiru trailed Kamanda by a margin of 14-thousand votes.
Kamanda emerged the winner with 49,306 votes against Bishop Wanjiru's 34,871, a difference of 14,435.
Wanjiru who vied the seat on an ODM ticket was announced winner after defeating Kamanda of PNU by 895 votes.
Kamanda moved to court immediately after the results were announced seeking a redress claiming the whole election was riddled with irregularities.
The vote scrutiny registered several anomalies ranging from failure by the presiding officers to sign Form 16A.
It was also discovered party agents failed to sign the forms as required by law and no reason was given.
From the outcome of the scrutiny, 35 ballot boxes could not be traced to any polling station.
This is the seventh judgment made by the High Court on election petition filed since the 2007 general election.
Other MPs who have lost their seats through election petitions in the Tenth Parliament include former Cabinet minister and Matuga MP, Ali Chirau Mwakwere, and former assistant ministers, Joel Onyancha (Bomachoge) and Omingo Magara (South Mugirango) Dick Wathika (Makadara), George Thuo (Juja) and Abdirahman Ali Hassan (Wajir South).
Makwere recaptured his seat three weeks ago. Thuo, former government chief whip will know his fate September 20 when the by-election will be held.
Other pending petitions include those of Dr Boni Khalwale (Ikolomani), Simon Mbugua (Kamukunji), Walter Nyambati (Kitutu Masaba) and Ngata Kariuki of Kirinyaga Central.
